NOTICE – AUGUST 2020 TO ALL ECONOMIC OPERATORS IMPORTING AND/OR OFFERING FOR SALE WATER-PIPE TOBACCO

INSTRUCTION NOTICE – AUGUST 2020 TO ALL ECONOMIC OPERATORS IMPORTING AND/OR OFFERING FOR SALE WATER-PIPE TOBACCO ALSO KNOWN AS SHISHA/GOZA/NARGHILE/GHALYOON/HOOKAH ETC

Kindly note that as from the 1st of October 2020, no water-pipe tobacco shall be placed on the market unless the packet, box or container immediately enclosing the water-pipe tobacco has been sealed by an excise stamp affixed as indicated by the Commissioner. The excise stamp is illustrated hereunder:
The excise stamp should be affixed in a way so as to ensure the destruction of the excise stamp upon the opening of such packet, box or container.
Such excise stamps shall be issued against payment on application by the authorised economic operator.
The said excise stamps shall be supplied by OpSec Security Malta Limited of 33, Triq Carini, Santa Venera.
The excise stamp shall be affixed to the packet, box or container by not later than five (5) days that the excise stamps was bought by the economic operator.
Any quantity of water-pipe tobacco found in the possession of any person in contravention of the provisions of the Excise Duty Act (Chapter 382) shall, without prejudice to any other penalty provided for under this Act or any other law, be forfeited to Government.

L-Operaturi/ Importaturi huma ġentilment mitluba jinnotaw li mill-1 ta 'Ottubru 2020, l-ebda tabakk imsemmi fit-titlu tan-notifika m'għandu jitpoġġa fis-suq sakemm il-pakkett, kaxxa jew kontenitur jekk ma jkunx ġie ssiġillat b'bolla tas-sisa mwaħħal kif indikat mill- Kummissarju tat-Taxxi. Id-disinn tal-Bolla tas-sisa huwa illustrat hawn taħt:
Il-Bollol tas-sisa għandhom jitwaħħlu b'mod li jiżgura l-qerda tagħhom mal-ftuħ tat-tali pakkett, kaxxa jew kontenitur.
Bolla tas-sisa bħal din għandha tiġi akkwistata bi ħlas permezz ta’ applikazzjoni mill-operatur ekonomiku awtoriżżat.
L-imsemmija Bollol tas-sisa jiġu mixtrija biss minn OpSec Security Malta Limited ta ’33, Triq Carini, Santa Venera.
Il-bollol tas-sisa għandhom jitwaħħlu fuq il-pakkett, kaxxa jew kontenitur sa mhux aktar tard minn ħamest (5) ijiem li l-bolol tas-sisa jkunu nxtraw mill-operatur ekonomiku.
Kwalunkwe kwantità ta’ tabakk imsemmi fit-titlu tan-notifika misjub fil-pussess ta’ xi persuna li tkun kisret ir-regolamenti ta' l-Att dwar id-Dazju tas-Sisa (Kapitolu 382) għandha, mingħajr preġudizzju għal xi piena oħra prevista taħt dan l-Att jew kwalunkwe liġi oħra, jiġu kkonfiskati minnufiħ mill-Gvern.
